I have been paying on my reara since 1995.L advice on how do you stop childd support payment on a child that is over 21 ?
it will not stop(arrears)until the arrears are paid, the ';child's'; age does not matterL advice on how do you stop childd support payment on a child that is over 21 ?
file motion in court, only option, arrears are arrears and only the court can stop a court order, Does this payment detrimentally affect you now, court can reduce the arrears amount, if the other parent was on state benefits while u were not paying and you were able to pay back then and chose not to, the court can take that into consideration cause u r really paying the state back and not the family anymore, and the state wants their money cause it took care of your child for you.
Now, if you were unemployed, sick or in prison during that time, when u file the motion make sure they know u were incapable of paying those years. if u r poor, u can file this yourself, for free .
The duty to pay is established by court order. The order says when to stop. If it doesn't, then apply to the court. Many judges will say that you must pay the same amount but that the difference goes to pay off the arrears more quickly.
The arrears occurred when the 21 year old was a minor and not an adult. They have to be paid off even if it takes until the 'child' is 35. You must have been quite far behind.
